the strikers in Pennsylvania

It would be comparatively easy
then to stretch the writ of injunc-
tion to cover at ill more ground and
no man woul i be allowed to com.

the latter was thoughtful enough
to apply to the court for a re-

This looks like a far fetched
oonoluslon at first glance, hut it is
painfully near the true hgie of the
situation and the tendency of the
recent exe^oiaa of arbitrary power
by the courtf. Tha right of peace
able assembly by the people has
never been denied before in this
country in times of peace. A court
in Pennsylvania, following the
precedent in West Virginia, now
declares that the miners sha'I not
assemble, march or encamp near
j the mines, nor houios of tha
miners, for the purpose of intimi-
i dation, menaoes, threats or oppro-
' hioui words So far there is not
Hiuh serious objection if the law
officers do not misinterpret per-
fectly lawful acts as ''menaces"
and "threats" and "intimidation.*'
But the court goes farther and in-
hibits nny one from "inducing"
any one < Ise t> quit work.
It must tie borne in mind that
thtt strikers have not indulged In
a cingle act of violenoe, and jet
they are told that they are pro-
mum d to be lawbreakers and riot-
tr* and must not oollaot near tha
mines, or attempt to,%induoe'' any
one to quit work. Was there ever
such a stretch of authority die
p'ayed before by an American
court? How far is it to the denial
of the right of assembly itself, un-
der any circumstance*? How much
further to the denial of the right
of the striker to publish hi* griev-
ance at all, or complain against
bin employer, lor fear the iact may
"induoe" some one at work to
quit?
Certainly the superior courts of
the country will not uphc > such
judicial attempts and tendencies
aa these to Uussianisa America.
And yet it is by gradual encroach-
ments of this character that the
liberties oí other peoples have
been strioksn down before onr day.
The striking minsra should pnt
the iqjunetlon to test and ascer-
tain at onoe whether tho oourts of
the country have suoh power over
«he personal righta and liberties of
the citizens. It is a matter the
public should rectify before, possi-
bly, it is too late.
