AUTHORIZING BOARD OF CONTROL TO LEASE STATE
LANDS.
H. B. No. 735.] CHAPTER 110.
An Act to authorize the State Board of Control to lease public grounds
and property of the State for agricultural and/or commercial purposes;
prescribing the mode and manner of making said lease; repealing
all laws in conflict, and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. All public grounds belonging to the State of Texas
under the charge and control of the State Board of Control, when
in the wisdom of the Board should be leased for agricultural or
commercial purposes, may be leased by said Board for the above
stated purposes, after lease proposal shall have been advertised
once a week for four (4) consecutive weeks in at least two (2)
newspapers, one (1) of which shall be published in the city
where the property is located, or the nearest daily paper thereto,
and the other in some paper with State-wide circulation; provided,
that such lease shall be subject to the approval of the Attorney
General of Texas, both as to substance and as to form.
The money derived from the lease of such property, less the expense
for advertising and leasing, shall be deposited in the State
Treasury to the credit of the general revenue fund; provided,
however, that if land leased belongs to any eleemosynary institution,
that money must be deposited to the credit of said institution
in the same manner that the special fund is now deposited
or may hereafter be ordered deposited by the Legislature.
SEC. 2. The Board of Control shall adopt proper forms and
regulations, rules and contract, as will, in its best judgment,
protect the interest of the State. The Board may reject any and
all bids. All laws and parts of laws in conflict herewith are
hereby repealed.
SEC. 3. Since there is no law authorizing the lease of public
grounds under the control of the State Board of Control for
agricultural and/or commercial purposes, this fact creates an
emergency and an imperative public necessity exists that the
constitutional rule requiring bills to be read on three separate
days in each House be suspended and this act be placed upon
third reading for final passage and take effect from and after its
passage, and it is so enacted.
Approved May 5, 1931.
Effective 90 days after adjournment.
