AUTHORIZING SALE OF ABANDONED SITE OF
SCHOOL OF MINES.
H. B. No. 29.] CHAPTER 9.
An Act authorizing the sale of certain lands owned by the State of Texas
located near El Paso, and known as the abandoned site of the State
School of Mines and Metallurgy; providing regulations in reference
thereto; authorizing the use of the proceeds of said sale for a recreation
hall and/or auditorium for said School of Mines and Metallurgy;
repealing Chapter 153 of the General Laws of the Regular Session of
the 39th Legislature, and all provisions of law in conflict herewith;
and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. The Board of Regents of the University of Texas
is hereby authorized to sell for the best price obtainable the
twenty-two acres of land owned by the State of Texas located
near El Paso, Texas, consisting of two tracts, one of four acres
and the other of eighteen acres, and known as the abandoned
site of the School of Mines and Metallurgy.
SEC. 2. Upon payment of the purchase price for said land
to the State Treasury, the Governor is hereby authorized to
execute, in behalf of the State, proper conveyance of title, and
if said land is sold to the United States Government for any
purpose specified in Chapter 2 of Title 86 of the Revised Civil
Statutes of Texas of 1925, the Governor is authorized, in the
name and in behalf of the State of Texas, to execute proper
conveyance of title and cede jurisdiction to said land subject to
the provisions and limitations of Article 5247 of the Revised
Civil Statutes of 1925.
SEC. 3. The proceeds of the sale of said land may be used by
the Board of Regents of the University of Texas for the purpose
of erecting and equipping a recreation hall or auditorium, or
combined recreation hall and auditorium, for the State School of
Mines and Metallurgy at El Paso, Texas. The same may be
constructed upon contract, or otherwise, as may be deemed by
said Board for the best interest of said School and the State.
The amount of the purchase price of said land is hereby appropriated
for the purpose mentioned in this section.
