CUSTOMS CONVICTED.
For several days past the time of tlio
Federal court has been occupied with
hearing the case of the United States vs.
Nelson 1'lato who wns charged with
Illegally releasing smuggled property.
We have given the substance of this
charge but repent It here for the benefit
of renders. Hunter Sntnpscl & Wells
were building n rntlroad In Mexico and
I'nt McKernon and his brothers were
sub-contractors under this linn. The
JIoKernons quit and crossed the river In
the United States and when they
reached this side were nircsted for
smuggling and their property consist-
ing of hordes mules wagons tents pro
visions etc. seized. Soon u member of
the ;lrm of Hunter Snmpscl fc Wells put
In nn nppearanco and claimed tho prop
erty as having been stolen from his linn.

the matter. He telegraphed to tho
Sccrotnry of tho Treasury for advice and
also sought tho advice of other Gov-

and requested their nllldnvlt as to own-
ership. He thought that ho had fully
compiled with the requirements of tho
law but when the grand Jury met a bill
of Indictment was found against him

for perjury. McKernon was tried dur-
ing the enrly pari of the week and ac-
quitted. Colonel Pinto's trlul upon a chnrgo of
unlawfully releasing the property which
a Jury had Just declared McKernon had

has civen ireneral satisfaction. He Is a
thorough gentleman and a man of a high
standard of honor and strlot integrity.

every portion of tho State sheep had
gone through the lata winter betterthan
