Rev. John Jasper colored pulpit astrono-
mer of Richmond Va. still defys the Coper-
nican system and maintaining the Jasper
dogma that the sun " do more."
General Topatz is kind enough to an-
ticipate he extermination of the Apaches by
General Crook. Nothing is now necessary
but to provide against disappointment.
The other day the Princess of Wales lost a
friend. Now it is announced that Wales him-
self has suffered a like bereavement in the
person of Rev. Jack Russet known as the
hunting parson. His royal highness is calm.

and back will improve it greatly beyond the
cost of freight and charges so that the result

mersleys of New York father and son. The
scourge was pneumonia. The former left an
estate variously estimated at from $5000000
to $11000000 to the son his sole heir. Tli
son had married but was childless and left
will bequeathing the usufruct of his property
to his widow during her lifetime and at her
death bestowing it upon public charities.
Three children of a brother of the elder
Hammerslcy cousins of the younger apply
to be recognized as legal heirs. They do not
contest the will of cither decedant holding
that both are valid. What they maintain i
that the will of the younger decedant (lis
posed only of his own estate owned an
possessed by him before he inherited the
patrimony ; that it made no disposition and
designed none of the succession of the elder
Ilammersley That hence the collateral heirs
take as heirs at law of the son.
This case presents a novel question or at
least not a settled one in testamentary juris
prudence. It has been usually held that a
last will disposes of an estate ol whatever it
consists at the time of the death. We be
lieve that the question has once arisen in
Louisiana anil that the civil law favors the
judicial interpretation sought by the Ham
mersley heirs. hatcver is reasonable is
lawful according to Justinian. There seems
no reason why a will should dispose of prop
erty a testator wis unaware he owned or
perhaps did not own at the time it was made
No reason why decedant as to such portion of
his estate should not be held to have died in'
testate. Yet there are reasons in the eye of
the English law plenty as blackberries.
The question for the New York jurist is
whether il the elder Ilammersley left say
$10000000 to his son and the latter
made no will after he acquired it shall the for
mer will be held to dispose of it shall the
willow be entitled to the usufruct and the
charitable institutions named to the final estate
in fee ? Of course the grounds upon which
a man's last will covers all his bequests is that
he would make another will if necessary. The
obstacles to making last wills are not con
sidered. What authorities there may be to
support the heirs at law will at least show the
contest to be an easier and safer one than to
have contested the validity of the wills.

The St. Louis Globe-Democrat wisely savs:

upon the average jury. They are appealed
to by all that is holy and sacred in the house-
hold in behalf of the affection they bear to
their wives daughters and sisters. There is
scarcely a situation in which it is easier to
cloud the judgment of thejmajnrity of the 12
men who are to give the verdict and make
them blind to the inadequacy of the testimony
for the defendint. They are led to believe
that their own personal reputation for honor
is at stake if they hesitate to acquit. One ef-
fect ot their action is to legalize the taking of
the law in his own hands by the individual
whose family honor has been assailed. This
is not a tenable position in the first place.
And when as in the Kentucky case there is
no direct proof of the alleged provocation
but the killer acts on his suspicions we find
another weak point in the philosophy of this
code of unwritten law. The killer is relieved
from the responsibility of making sure the
fact of offense. Delias but to be convinced
fit in his own prejudiced mind and an op
portunity is furnished for his counsel to let
forth the floods of their eloquence. If lie kills
ltiioui any real cause nut imagine it he can
e no more guilty of murder according to this
code than a hangman who strangles a victim
wrongly condemned.
The whole theory involved in the case is
wrong and there is no mistaking the fact
that the killer in cogitating upon the course
he shall pursue is influenced by the thought
that he is pretty sure to escape conviction i'
he commits the deed.The presumption is that
if Thompson had felt reasonably certain that
he would hang for killing Davis he would
have refrained from the act especially as he
had plenty of time to think about what he
was doing. A verdict or two from juries to
show that a man must be held responsible
ior Killing another except in self-defense
tvouiu put an ena to such things as the
fhuinpson-Davis tracedv. There is noth
ing in this view of the matter to be construed
as condoning the offense of Davis if he com-
mitted it. It is simply a stand for the supre-
macy of law and the protection of human life
Female honor does not require any such de-
fenders as Thompson. It it does it is not
worth defending.
These words arc timely and pregnant with
goud common sense. They deserve to be re-
ceived with respect by citizens of all States
and treasured up in memory. Those who are
guardians ofj the public rights the jurors
should bear them forcibly in memory when
such cases come before them. Then law and
order shall prevail and human life receive due
protection.
