448 SPECIAL LAWS.
upon the defendant or defendants in such suit in manner as
now provided by General Law. Such suit or suits shall be instituted
and prosecuted in the name of the Bishop Independent
School District as plaintiff.
SEC. 25. The available school funds that heretofore or it
may be hereafter apportioned'to the schools with the territory
embraced within said independent school district, shall be paid
immediately upon the passage of this Act and the organization
of the said board of trustees, to the treasurer of said board.
SEC. 26. One election may be held in each year to determine
whether or not a special tax, as herein provided for bonded indebtedness
or maintenance, shall be levied, notwithstanding an
election held in the preceding year may have resulted contrary
to the proposed tax.
SEC. 27. The said board of trustees shall have authority to
pay out of the funds derived from maintenance tax the cost of
collection and disbursement of taxes and the expenses contingent
upon the issuance and negotiations of any bonds.
SEC. 28. The absolute title to all property within the Bishop
Independent School District, as herein created and established,
of right belonging to the use of the public free schools, from
whatever source derived, including any and all funds on hand
belonging to the public schools within said territory shall upon
the passage of this Act, vest in the board of trustees of said
Bishop Independent School District and their successors in
office.
SEC. 29. Before the bonds authorized by this Act are offered
for sale, the Attorney General shall officially certify to their
validity in the same manner as provided by law in cases where
any county, city, or town in this State issues or offers bonds
for sale.
SEC. 30. And whereas, by an election duly held in and for
said Bishop School District, said district voted a maintenance
tax within the limit provided by the Constitution of this State,
and also issued bonds to the amount of seventy-five thousand
($75,000) dollars, which said bonds have been sold, therefore
said election and the issue and sale of said bonds and the levy
of said maintenance tax are hereby in all things ratified, confirmed
and validated; and the same shall be valid and binding
obligation upon the Bishop Independent School District, as
herein created, subject to provision of Section 32 of this Act.
SEC. 31. As to all matters not provided for in this Act, the
board of trustees created hereunder shall have and exercise and
are hereby vested and charged with all the rights, powers, privileges
and duties conferred and imposed by the General Laws
of this State, now in force or hereafter enacted, upon the trustees
of independent school districts under the General Laws of
this State.
SEC. 32. Within sixty days after this Act becomes effective
the board of trustees of the Bishop Independent School District
shall order an election to determine whether or not the entire
