A Cherokee County Deputy
Sheriff is recuperating from
gunshot wounds in the abdo-
men and right foot following a
gun battle at 6:30 p.m.
Saturday at a Jacksonville
residence.
Cherokee County Sheriff
John B. Slover reports that
Deputy Bobby Van Ness was
wounded while attempting to
serve a warrant on Cecil B.
Prosser at this residence at 319
Austin Street in Jacksonville.
"Van Ness will be off for
several days but was reltased
from the hospital late Saturday
night after being treated for
the two wounds." says Sheriff
Slover.
Slover reports that he
received a call concerning a

Wounded In Gun Battle
family disturbance Saturday
afternoon at the Austin Street
address in Jacksonville. "I told
the lady we could not do
anything without a warrant."
Mrs. Freda Wooten of the
same address filed a complaint
for aggravated assault around
6p.m. in the office of Justice of
the Peace C. L. England.
Van Ness went to the
residence to serve the warrant.
A Jacksonville Police Depart-
ment unit arrived at the scene
shortly before the shooting
started.
"Députy Van Ness went up
on the porch and this was when
the suspect started shooting,"
says Slover. "Van Ness and
other officers ran for cover. He
(Van Ness) jumped in the
Jacksonville PD unit to call for
help." Slover continues, "The
suspect came out on the porch
and continued to fire, hitting
Van Ness in the foot." The
deputy radioed Sheriff Slover,
who was only a few miles away
at the time, and said, "I'm
shot." Van Ness was the only
officer to return fire on the
suspect, however he did not hit
the gunman. Prosser then
retreated to the house.
Later Prosser phoned the
Jacksonville Police Depart-
ment from inside the house and
said he wanted to give himself
up. He then called out to the
officers outside his home
saying, "Hold your fire. I'm
coming out."
According to Sheriff Slover
Prosser was using a .308
caliber high powered rifle.
The 93 year old white man
was arraigned before Justice
of the Peace England and
charged with assault with
intent to murder a police
officer. Bond was denied.
Prosser was later transferred
to the Cherokee County Jail.
