Chapter 136 S.B. No. 1103 1 AN ACT 2 relating to the use of a perpetual trust fund for a cemetery by 3 certain municipalities. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 713.008, Health and Safety Code, is 6 amended to read as follows: 7 Sec. 713.008. TERMINATION OF MUNICIPAL TRUST BY CERTAIN 8 MUNICIPALITIES. The governing body of a municipality in a county 9 with a population of at least 128,000 but not more than 300,000 10 [133,004] may abolish the municipality's perpetual trust fund for a 11 cemetery and use the fund, including both principal and interest, 12 for permanent improvements to the cemetery. 13 SECTION 2. This Act takes effect immediately if it receives 14 a vote of two-thirds of all the members elected to each house, as 15 provided by Section 39, Article III, Texas Constitution. If this 16 Act does not receive the vote necessary for immediate effect, this 17 Act takes effect September 1, 2009.
