1 AN ACT 2 relating to a transportation plan for persons furloughed or 3 discharged from certain mental health facilities. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Subchapter F, Chapter 574, Health and Safety 6 Code, is amended by adding Section 574.089 to read as follows: 7 Sec. 574.089. TRANSPORTATION PLAN FOR FURLOUGH OR 8 DISCHARGE. (a) The facility administrator of a mental health 9 facility, in conjunction with the local mental health authority, 10 shall create a transportation plan for a person scheduled to be 11 furloughed or discharged from the facility. 12 (b) The transportation plan must account for the capacity of 13 the person, must be in writing, and must specify: 14 (1) who is responsible for transporting the person; 15 (2) when the person will be transported; and 16 (3) where the person will arrive. 17 (c) If the person consents, the facility administrator 18 shall forward the transportation plan to a family member of the 19 person before the person is transported. 20 SECTION 2. This Act takes effect September 1, 2009.
