our efforts to build up Texas and every

year is equivalent to more than $300,-

Of all our minerals the fuels, which
supply heat, light . and power for
domestic as well as Industrial pur-
poses, are the most fundamentally
essential to the nation. The’use of the
fuels involves their Immediate and
complete destruction. The use of large
supplies of other materials also in-
creases the rate of consumption of the
ha* now passed its early development
stage, manufacturing and consequent-
ly the use of the fuels will increase
much more than population.
The available and easily accessible
supplies of coal in the United States
aggregate approximately 1,463,800,000,-
000 tons. At the present increasing
rate of production this supply will be
so depleted as to' approach exhaustion
before the middle of the next cen-
tury.
From the beginning of coal mining
in this country down to the close of
1907, there were mined 6.865,000,006
tons, and It is estimated hat for every
ton produced half a ton has been lost
or wasted; so that the above produc-
tion represents an exhaustion of the
coal supply to January 1, 1908, aggre-
gating 10,200.000,000 tons. rhe rate of
production has been steadily increas-
ing.
The first step in extending the lireor
our fuel supply, according to the re-
port. should be to lessen the waste in
mining, handling and transportation of
coal. But there are equally great pos-
slblo savings. It says. In the use of the
coal, not only In the prevention of

versy resulted in a suit being filed in
the county court of Galveston county
by the Albertype company for $375.
। Judgment was rendered in favor of the
Albertype company. The Gust, Feist
i company in making a motion for a re-
hearing, among other things, for the
first time, presented the question that
the contract made between the com-
pany and' the Albertype company was
void under the anti-trust act ot 1905
The county court overruled the motion
and an appeal was taken to the court
of civil appeals for the First district
at Galveston, which court reversed the
judgment of the county court and dis-
missed the case because the contract
sued on violated sections 3 and 4 of
the anti-trust act of 1903. The su-
preme court held that the transaction
was between a New York concern and.
a Texas citizen and is interstate com-
merce, which is not subject to the anti-
trust law of Texas. The supreme court
also declared that the court of civil ap-
peals erred in holding that the contract
in the. suit is prohibited by the anti-
trust act of 1903.
