The ballot Is said to be the palladium
of the liberties of American citizens nnd
truly so for It Is the only mode In w hlcli
the citizen has of governing himself mid
declaring his will in the administration
of the government municipal suite or
leuerai oi wnicn ne iorms a constituent
part. This being the only power of self
government which Is the only atlrlbotu
of a free government nml therefore uu
Invaluable rlnlit. It should not be lluhlly
taken from the citizen and exercised by
a few. This much has been Raid loshoiv
that the Legislative act extending the
term of nn electlvo office should bu
strictly construed and If It can be con-
strued upon nny oilier hypoth-
esis except that of extension
then it must be done so ns to reserve to
the citizen the right to elect his own
officers. Much linsbeen said wllh refer
ence to the word all in my former i tun-
muiilcatlon. it was leu out inntiwr-
tunlly but It Is betterso as It will serte
to Illustrate I no lunacy oi the position
that the terms were thereby extended
l sniu "ine terms oi niuermen eieeieu
prior to February 187 shall expire"
ete. What noes that mean that the term
of ail aldenrten elected prior to Febru-
ary IN-? shall expire nt that time or
only some of them. If that sentence as It
stands means nil aldermen ns It certain-
ly does llien what cflect lias the word
all upon the sentence. It neither adds
to or takes anything from It. It Is mere
surplusage and means nothing and If the
right to hold over is based on t lie word
a i.i It Is based upon nothing. That
straw Is too light lu save a drowning
man.
It Is further contended that sect on .
of the old charter Is abrogated and the
amendment Is In force. 1 contend that
the election clause of the old charter Is
still In foroe ns sections of the amend-
ment specially provides that it 'hall not
begin until the second Monday In Feb-
ruary 1SS7; will II be contended that we
nnu no ciccuoii law iroiu i3-u io ifs.;
that cannot lie as one act does not ter-
minate until the other begins. Section
. provides that "on the second Monday
in February beginning Willi the year
IW eto." therefore the old charter con
tinues until that time lly the same
process oi reasoning u migiii ue argued
Hint when I he nniendeil charter was
enacted providing that the Council
should before December lfnU di
vide the city Into eight wards
Instead of four. It immediately
obliterated all ward division lines and
we had no wnrds until it was again di-
vided Into eight and wo had during
that time no Aldermen representing
wards as required br the charter and
therefore thu entire board was illegal;
this proposition would not be sound and
yet It would be as reasonable as the
other. They arc both acls to be done at
a iuturo nine anu ine lormer act con-
tinues until the subsequent act by Its
on n terms goes Into operation.
as i saiu oeiore ine act oi i net Legis-
lature taking from the citizen his right
by ballot to select elective otllcers must
be strictly construed and If It can be
construed upon any other reasonable
hypothesis It must be done. Now Is It
not I lie plain provision ns "ell as n rea-
sonable hypothesis that the provision
of section 0. that the terms of all Alder
men elected prior to February 1SM7
biiau expire nr tnai lime means uiai
none shall extend beyond it. ?
it uoes not attempt to inieriere in nny
mnnner except to say that nil terms
must expire here. It has nothing to do
with or sayjiooiit terms expiring before
that time. It does not go Into operation
until feuruary therefore does not
and cannot operate on terms exnlrini!
oeiore mat time it simpiy proviues
