states that: “A person
commits an offense if he
intentionally or knowingly
makes unreasonable noise
in a public place other than
a sport shooting range, as
defined by Section 250.001,
Local Government Code,
or in or near a private
residence that he has
no right to occupy.”
According to the
ordinance, “a noise
is presumed to be
unreasonable if the noise
exceeds a decibel level of
85 after the person making
the noise receives notice
from a magistrate or a
peace officer that the noise
is a public nuisance.”
An offense under
this ordinance is a
Class C misdemeanor,
Livingston advised.
“So, if you reside in
the county, you may
use fireworks but if the
sheriff’s office receives a
complaint and it meets the
requirements of Section
42.01, a deputy will request
the persons stop the use
of the fireworks in that
area,” Livingston said.
In the county, Livingston
said, “A warning will be
given first by a deputy.
After that a citation can
be issued if needed.

Many New Year’s
revelers add fireworks to
their celebration rituals.
But, if they shoot
fireworks inside the city
limits of Mount Pleasant,
or within the boundaries
of Titus County, they are
celebrating illegally.
The cost of celebrating
with fireworks could
cost them considerably
more than they spent
on fireworks.
Mount Pleasant Police
Department Chief Wayne
Isbell said shooting
fireworks inside the city
limits is not allowed.
“It’s illegal. A Class C
citation will be issued and
the fireworks taken. The
court fine is $245,” he said.
Titus County Sheriff
Chief Deputy John P.
Livingston said shooting
fireworks in the county
is prohibited, as well.
Since the Titus County
Commissioners have not
issued a recent ordinance
regarding fireworks,
Livingston said, law
enforcement in the county
must adhere to Title
9 Chapter 42, Section
42.01 which addresses
disorderly conduct.
