Austin, Texas/ July 29.—Attor-
General Davidson held that the
depository law is binding and not
optional with the counties of the
State, as will be seen from the fol-
lowing opinion.
Austin, Texas; July 28.—Hon. W.
H.'Russell, County Judge, Here-
ford, Texas: Dear Sir—I have your
letter in regard to what is known as
the county depository law (Sec. 20
to 33 of the act of May 1, 1905,
providing for a system of* State,
county and city depositories).
I am of the opinion that the Com-
missioners' Court has not the dis-
cretion to determine whether or not
a county depository shall be selected,
but that the Legislature has de-
terlnined that such a selection shall
be made and has imposed the duty
of making it upon the Commissioners'
Court.
It is the duty of the

These provisions sufficiently show
that the act does not confer upon
the court a discretion but it is man-
datory and imposes upon it the duty
of selecting a depository for all of
the funds of the county, if that can
be done, or one or more depositories
(under Sec. 25) if no acceptable
proposal for all bf the funds is re-

it shall be their duty to deposit the

In sec. 20 it is provided; "Notice
that such bids will be received shall

A Splendid Opportunity for Home-

Favored Portion of the
Northwest.
Fort Worth, Texas, July 24,1905.
To The Editor: Advices are
received to the effect that the Uinath
Indian Reservation in Utah will be
thrown open by the Government for
settlement on August 28th and that
on account of same individual regis-
trations for the land will commence
August 1st at Grand Junction, Colo-
rado, and at Vernal, Price and'
Provo, Utah, such registrations to
close August 12th.
Drawings to determine the order
in which selections of the land máy
be made, will be held at Provo,
Utah, commencing Thursday, Aug-
ust 17th, and the applications of
those participating and drawing
numbers from 1 to 50, inclusive,
must be presented at Vernal, Utah,
August 28th, when they will be con-
sidered in their numerical order
during the first day; the applications
of holders of numbers 51 to 100 in-
clusive to be presented on the second
day, and so on until all numbers
have been disposed of.

not yet become a systematic and per-
fect organization; but when 'tis
remembered that it is only about

tention at home, the town and church
being new, this auxiliary is not the
recipient of any special distinction
