court has again declared that the case
of the contestee will be closed Saturday

was under investigation yesterday in
the governorship contest. In this pre-
cinct former governor Hunt received
a majority of IS. According to the tes-
timony one of the members of the elec-
tion board Instructed many of the
voters by means of sample ballots

Trinidad. Colo April 7 Fire in the
Victor American fuel company mine.
No. 8. at Hastings is believed to have
trapped 110 coal miners members of
the day shift.
Fire -was first noticed coming out of
the mouth of the mine shortly after
9:30 this morning. Helmet crews
which entered the mine shortly after
10 oclock had made no report this
afternoon as to -whether or not they
had reached the entombed men. The
cause of the fire is unknown.

Clash of Counsel in Court
Brings Sharp Reprimand
From the Judge.
j Coleman Texas. April 27 To dozen
j witnesses from "Waco Texas gave
testimony regarding the good charac
ter of Harry J. Spanell today at his
trial in connection with the killing of
Lieut. CoL M. C. Butler at Alpine
Texas last July.
Spanell and his wife. .Crystall Hol-
land Spanell of -whose murder he -was
acquitted at San Angelo. formerly lived
at Waco.
There -was a tense moment during
yesterday afternoon's session when
attorney "Williams for the defence
questioned a witness concerning
alleged misconduct of Butler. The
court sustained the state's objection.
Attorney J". A. "Wright leading
state's counsel told the court if
"Williams asked any more such ques-
tions "I will start something right
here."
"Tou just try It. and Til put you In
Jail." Judge "Woodward presiding re-
plied. "I sustained your objection but
I won't stand for any threats. Go
back and sit down."
"Wright apologized saying he meant
no offence to the court and the Inci-
dent was dismissed.

Texas Senate Resolution
Asks That War Message
Be Read to Pupils.
Austin. Texas April 27. The senate
trday adopted a resolution introduced
by senator Henderson requesting that
president "Wilson's war message to
congress be read in all the public
schools of Texas.
The bill providing for the appoint-
J lent of national guard officers by the
governor was up for consideration
when the senat- adjourned until 10
oclock Monday morning.
Senator McN'ealous announced in the
senate that he did not propose to ask
governor Ferguson to Issue a proc-
lamation calling the proposed constitu-
tional convention. It is understood the
matter Is to be taken into the courts.
The house had no morning session
but convened this afternoon at 2 oclock.

In the senate today on the occasion of
the official presentation to the state of
a portrait of Gen. John A. "Wharton
commander of the famous Terry
Rangers association through a com-
mittee composed of MaJ. Geo. "W. Little-

and CoL B F. "Weems. of Houston. It
was hung on the wall of the senate
chamber.

market today. May wheat rising 15 i
cents to SI 70. This was followed im-

volume of trade was smalL
