S E N R A L Under provisions set out in the Texas Constitution, the Texas Government Code,
STitle 4, 402.042, and numerous statutes, the attorney general is authorized to write
advisory opinions for state and local officials. These advisory opinions are
requested by agencies or officials when they are confronted with unique or unusually difficult legal questions. The attorney
general also determines, under authority of the Texas Open Records Act, whether information requested for release from
governmental agencies may be held from public disclosure. Requests for opinions, opinions, and open records decisions are
summarized for publication in the Texas Register. The attorney general responds to many requests for opinions and open
records decisions with letter opinions. A letter opinion has the same force and effect as a formal Attorney General Opinion,
and represents the opinion of the attorney general unless and until it is modified or overruled by a subsequent letter opinion, a

SUMMARY
The word "proceeding" for the purposes of a suit to adjudicate the pater-
nity of a child includes all possible steps in the action. The final order
in such a suit is open for inspection and copying, whatever the nature
of the judgment. Save with the consent of the parties or by court order,
any and all other records of the proceeding are permanently closed.

Re: Whether Exchanges of the Farmers Insurance Group of Compa-
nies are "authorized insurers" that are required to file withdrawal plans
under article 21.49-2C of the Texas Insurance Code; whether their pro-
posed refusal to renew policies of homeowners in Texas would violate
state law; and whether the Commissioner of Insurance may impose a
moratorium on the approval of a plan for withdrawal (RQ-0620-JC)
SUMMARY
The refusal of Farmers Insurance Exchange and Fire Insurance Ex-
change to renew the policies of Texas homeowners would not violate
state law, provided that the Exchanges follow the notice procedure set
forth in article 21.49-2B, section 5 of the Insurance Code. The Ex-
changes would not be required to file a plan for withdrawal from the
Texas homeowners' insurance market, as they are reciprocal exchange
insurers that are not regulated by article 21.49- 2C of the Insurance
Code. Nor are reciprocal exchange insurers subject to a moratorium
issued by the Commissioner of Insurance.
