kECOMMENDATIONS
1 A complete revision of the marginal well statute to eliminate the incentive
for placing a well on marginal status and to provide criminal penalties
for violation. The production from a marginal well should not exceed that allowed
a prorated well. This can be done by setting marginal rates lower than the present
statute fixes them and by setting these rates on a monthly rather than a daily basis.
2. The theft statutes should be strengthened by making it an offense to drill
a well intentionally into land owned by another and to remove oil therefrom. There
is no need for a statute to regulate drilling as such as this seems better left to
regulations by the Railroad Commission.
3. A law to provide criminal penalties for willful violation of legal regulations
promulgated and adopted by the Railroad Commission.
4. A False Official Statements Act to require reports and other materials
officially filed with instrumentalities of government to be signed under penalties
of perjury.
5. A Conflict of Interest Statute to establish a standard of conduct for all
state officials and employees and to provide criminal penalties for violation.
6. A constitutional amendment to provide legal procedures for the temporary
replacement of state officials who are physically incapacitated from performing
their duties or who for any reason are unable to perform their duties.
7. Existing theft statutes should be strengthened by a law creating a new
offense of "theft of oil" and providing criminal penalties.
8. Existing bribery statutes should be revised and strengthened.
