REVISED BRIEFING RULES.
(1) Caption.
(2) "Statement of the Nature and Result of the Suit."
(3) Separately Subdivided and Numbered "Propositions upon
which the appeal is predicated," referring to assignments
to which they are germane, by number.
(4) Argument under several propositions, aforesaid, with reference
to authorities and statement of the record bearing
on respective propositions, referring to page of record.
Set out in full all charges and issues given or refused and
all evidence admitted or rejected made the basis of complaint.
Make statement in argument "correlated, entire and distinct."'
Make statement even if no argument.
(5) Verbatim copies of assignments, in back of brief, or immediately
following the statement of the case. I think latter
place probably preferable.
(6) Brief may be written, typewritten or printed. (R. S., Art.
1614, as amended by Acts 37th Leg., Ch. 107, p. 210.)
If typewritten, it shall be double spaced; if written, it may
not exceed fifteen pages. (Revised Rule 34. as amended
\November 16, 1921.)
(7) If brief of more than 20 pages, front fly leaves shall be
complete index showing:
(a) Different features of the brief.
(b) Page of each proposition.
(c) Page of statement and argument under each proposition.
(d) Assignment on which proposition based.
(e) Alphabetical list of cases and authorities, with
page of brief where cited.
(8) Sign brief.
(9) Give P. O. address of attorneys signing brief.
(10) Examine the new rules when making each brief.
NOTE-From Revised Rule 31, requiring the argument to contain
"The necessary statement from the record correlated, entire and distinct,"
and from Revised Rule 35, requiring the index to show the
"statements from the record," "and the argument thereon," I am
inclined to think that a, separate portion of the space in the brief
given to the argument should, by appropriate sub-heading, be given
to a "statement."
