VALIDATING CERTAIN ROAD BOND ELECTIONS.
S. B. No. 15.] CHAPTER 8.
An Act to amend Chapter 143, local and special laws of the 39th Legislature,
at its First Called Session, 1926, the same being a special law
validating the creation of Road District No. 2 of Chambers County,
Texas, by adding to said Chapter new sections numbered 5a and 5b,
validating Road Bond election held on June 12, 1937, and further
prescribing the duty of the Commissioners' Court in reference to the
issuance of such bonds; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That Chapter 143, local and special laws of the
39th Legislature, at its First Called Session, 1926, be amended
by adding thereto Sections 5a and 5b as follows:
"Section 5a. That the order adopted by the County Commissioners'
Court on the 10th day of May, 1937, submitting to the
resident property tax-payers who were qualified electors of said
Road District at an election to be held in said Road District on
the 12th day of June, 1937, the proposition of issuing bonds of
said Road District in the amount of Seven Hundred Fifty Thousand
($750,000.00) Dollars, and the levy of an ad valorem tax
upon the taxable property therein to pay interest on said bonds
and provide a sinking fund for the redemption thereof, for the
purpose of constructing, maintaining and operating macadamized,
graveled or paved roads and turnpikes, or in aid thereof,
and the notice of said election given by posting and publication,
the form of ballot used thereat, and the canvass of the vote cast
at said election as recorded in the minutes of said Commissioners'
Court revealing that a two-thirds majority of such resident
qualified property tax-payers who were qualified electors voting
on the proposition voted in favor of the issuance of such bonds
and levy of such tax, are hereby legalized, approved and validated,
and the Commissioners' Court of said county is hereby
authorized and directed to enter any and all orders and provisions
necessary for the purpose of issuing the bonds authorized
to be issued by said election, in accordance with the provisions
of this Act."
"Section 5b. The bonds for said Road District, when issued
in accordance with this Act, approved by the Attorney General
of the State of Texas, and registered by the Comptroller of
Public Accounts of the State of Texas, shall be and are made
valid and binding obligations of said Road District and may be
enforced by the holders thereof in the same manner and to the
same extent as any other bonds of road districts of the State
of Texas, in accordance with any general or special law now
existing or hereafter enacted for the benefit of the holders of
such bonds."
