CERTAIN COUNTIES AUTHORIZED TO PURCHASE
LANDS FOR PUBLIC PARKS AND COMMISSIONERS'
COURTS TO ISSUE BONDS OR TIME
WARRANTS IN PAYMENT THEREOF.
S. B. No. 78.] CHAPTER 13.
An Act to authorize each county, and the Commissioners' Court thereof,
of the State of Texas, which has a population of more than 250,000 and
less than 300,000 as shown by the last official Federal Census to acquire
by purchase lands for use as county public parks and authorizing the
Commissioners' Court of each such county to issue and deliver bonds
and/or time warrants in payment for such lands of not exceeding an
aggregate principal amount of Twenty-five Thousand ($25,000.00) Dollars,
without submitting the same to the voters or to any election and
authorizing the Commissioners' Court of each such county to levy, assess
and collect a tax to create necessary sinking fund to pay such bonds and/or
time warrants at maturity and to pay interest thereon; this Act shall
expire and cease to be in force and effect after July 1, 1934, except any
bonds and/or time warrants issued prior to said date and maturing thereafter
shall remain valid and in full force and effect until paid, and
declaring emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That, anything in any existing Article of the
Revised Civil Statutes, or in any other existing statute or law,
of the State of Texas to the contrary notwithstanding, each
respective county, and the Commissioners' Court thereof, of the
State of Texas which has a population of more than 250,000 and
less than 300,000, as shown by the last official Federal Census
is authorized to acquire by purchase lands for use as county
public parks and to issue and deliver bonds and/or time
warrants of such county, maturing in equal annual installments
not exceeding five years from their date, in payment therefor
without submitting either the proposition for the purchase of
said lands or the proposition for the issuance of such bonds
and/or time warrants to the voters or to any election; and, the
Commissioners' Court of each county having a population of
more than 250,000 and less than 300,000 as shown by the last
official Federal Census is authorized to levy, assess and collect
annually out of the tax authorized by Section 9 of Article VIII,
of the Constitution for the erection of public buildings, streets,
sewers, waterworks and other permanent improvements, such
a tax on each One Hundred ($100.00) Dollars, of the assessed
valuation of the county for the purpose of creating necessary
fund to pay interest on such bonds and/or time warrants and
to provide sinking fund to retire said bonds and/or warrants
at maturity; provided, however, that there shall never be issued
and outstanding at any time such bonds and/or warrants
of any county in an aggregate principal amount exceeding
Twenty-five Thousand ($25,000.00) Dollars.
SEC. 2. Except as provided for specifically above in Section
1 hereof, all existing Articles of the Revised Civil Statutes, and
other existing statutes and laws, of the State of Texas, shall
