and Captain William Headen arrived. Tho
engineer and conductor of tba special train as
well as Colonel Lister being aboard tho .train

After dinner at tho station wo were driven
to the beautifully located city of llustamante
soino tbreo miles from tho station and directly
to the residence of I.lu Apolonlo Mores Judge
of tho VUlaldama district. Wo wero ushered
Into u very pleasant parlor where wo were In-
formed that his Honor was enjoying n siesta.
After wultlng about 30 minutes the Judge cumo

The court of Inquiry was held In a largo room
across the portou and opposite tbo parlor.
After a few inomonts' delay tho examination
of witnesses began. Colonel Lister Is t om his

follows: On last Wednesday morning a young
Mexican named Alborto Sanchez who resides
at Sultllr . purchased a second-class ticket from
Muntcioy to Laredo. On account of tho heat
or olso becauso be wanted to sco tho town he
stopped otr at llustamante Intending to tako
tho night trau. About S o'clock the
next morning when tbe south bound
train came bolting along; nine kllometros
nortu or iiuituinante station the engineer dls
covered almost at tho sumo Instant two nh.

versed blj engine but not before bo discovered
that tho tlrst object was a human being and

hours. Colonel P. A. Lister who was aboard
tho train was u wakened uy the conductor and
be gavo Instructions to put tbo body aboard
tbe train and when Burtamante was reached
order the car coutalug the body to be placed
on ii sldo track and tell the railroad agent to
notify tbo anthorlties Immediately and also toll
them that ho would have the crew to return to
Uustamaiito us soon as possible to testify. The
train then proceeded on towards Monterey as
far Kg Salinas which was tho meeting point for

while no second class tickets are sold for the
mixed or night trains no ticket Is refused of
whatever class. It was stated by a Mexican
witness that he was sure to enter tho
coach as there Is nover but ono coach
attached to this night frrlght train and Con
ductor forties protesting mat ne never saw
tho man and no second-class ticket from Mon-
terey was collected. It seouis eloar to mv mind
that Saiil-hez was told that his ticket wus value-
less and If bo did enter tbe couch he never
stopped but went on nhcud and tried to con-

given them by the Mexican courts insisted
that they should return and testify but they
positively refused saving that thov had tno
close a call and they would not run tho risk
