1 AN ACT
2 relating to funding under the instructional facilities allotment
3 and to payment of existing debt for school districts affected by
4 troop reassignments at military installations.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
6 SECTION 1. Section 46.006, Education Code, is amended by
7 adding Subsection (c-2) and amending Subsection (d) to read as
8 follows:
9 (c-2) A district's wealth per student is reduced by 25
10 percent for purposes of this section if the district demonstrates
11 to the commissioner's satisfaction that the district must
12 construct, acquire, renovate, or improve one or more instructional
13 facilities to serve the children of military personnel transferred
14 to a military installation in or near the district under the Defense
15 Base Closure and Realignment Act of 1990 (10 U.S.C. Section 2687).
16 The reduction is in addition to any reduction under Subsection (a),
17 (b), or (c) and is computed before the district's wealth per student
18 is reduced under those subsections, if applicable. This subsection
19 expires September 1i, 2012.
20 (d) The commissioner shall adjust the rankings after making
21 the reductions in wealth per student required by Subsections (a),
22 (b), [an4] (c), and (c-2).
23 SECTION 2. Effective September i, 2012, Subsection (d),
24 Section 46.006, Education Code, is amended to read as follows:
