the assessment and collection of taxes for free school purposes that
are now conferred by law upon the city marshal of an incorporated
town or village, and he shall receive compensation for his
services in such amount as the board of trustees shall allow, not
to exceed four per centum of the whole amount of taxes received
by him, and he shall give bond to be approved by the board of truslees,
in double the estimated amount of taxes coming annually into
his hands, which bond shall be made payable to the president of the
board of trustees and to his successors in office, conditioned for the
faithful dicharge of his duties, and the payment of the taxes received
by him to the treasurer of said independent school district.
SEC. 11. When a majority of the board of trustees of said district
prefer to have the taxes of their district assessed by the county
tax assessor and collected by the county collector, the same shall
be assessed and collected by such county officer's, and turned over to
the treasurer of said district for which such taxes shall have been
collected; provided that the property of said district, when assessed
by the county tax assessor shall not be assessed at a greater valuation
than that assessed for county and State purposes; provided,
further, that when the county assessor and county collector are required
to assess and collect the taxes of said district, they shall
respectively receive one per centum for assessing and collecting the
same.
SEC. 12. Property valuations in said independent school district
shall be the same as fixed by the board of trustees thereof, and the
said board of trustees is hereby given all power and authority now
conferred by law upon commissioners' courts when sitting as boards
of equalization fixing property values in said district.
SEC. 13 It is hereby expressly provided that Harmony Independent
School District as created by this Act shall assume and discharge
its pro rata part of any bonds and interest to accrue thereon, which
may now be valid and binding obligations of Gomez Independent
School District in Terry County, Texas, in proportion that the
assessed valuation for the year 1922 of the territory taken from the
said Gomez Independent School District bears to the total assessed
valuation of said district. It is further expressly provided that
said Harmony Independent School District, as created by this Act,
shall assume and discharge its pro rata part of any bonds and interest
to accrue thereon which may now be valid and binding obligations
of the Brownfield Independent School District in Terry County,
Texas, in proportion that the assessed valuation for the year 1922
of the territory taken from the said Brownfield Independent School
District bears to the total assessed valuation of said district
SEC. 14. All taxes, if any, heretofore voted by the qualified voters
of any common school district, or independent school district, which
included all or a part of the lands included within the boundaries
of the independent school district as created by this Act, and now
in force in any such common school district, or independent school
district, are hereby validated and continued in force in the independent
school district hereby created until such time as a majority
of the qualified property tax paying voters of said independent
