S.B. No. 2197 Chapter 846 1 AN ACT 2 relating to fees paid to a constable for serving civil process. 3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 4 SECTION 1. Subsection (d), Section 86.021, Local Government 5 Code, is amended to read as follows: 6 (d) Regardless of the Texas Rules of Civil Procedure, all 7 civil process may be served by a constable in the constable's county 8 or in a county contiguous to the constable's county, except that a 9 constable who is a party to or interested in the outcome of a suit 10 may not serve any process related to the suit. All civil process 11 served by a constable at any time or place is presumed to be served 12 in the constable's official capacity if under the law the constable 13 may serve that process in the constable's official capacity. A 14 constable may not under any circumstances retain a fee paid for 15 serving civil process in the constable's official capacity other 16 than the constable's regular salary or compensation. Any fee paid 17 to a constable for serving civil process in the constable's 18 official capacity shall be deposited with the county treasurer of 19 the constable's county. 20 SECTION 2. The change in law made by this Act applies only 21 to civil process served by a constable on or after the effective 22 date of this Act. Civil process served by a constable before the 23 effective date of this Act is governed by the law in effect 24 immediately before that date, and that law is continued in effect
