The accused desired that Warrick Tunstall Esq. be permitted to
act as his Counsel which was granted.
The Accused announced himself ready for trial. The Charges
were then read aloud by the Judge Advocate, as follows:

W. P. M. Means
Charge Ist
"Alien Enemy"
In this, that the said W. P. M. Means, being a Citizen of Boston,
State of Massachusetts, U. S. of America, did, contrary to the Proc-
lamation of the President of the Confederate States, relating to
"Alien enemies" & in a manner and under circumstances throwing
suspicion upon his movements and objects, come within the limits
of the Confederate States, where he has since remained.
Charge 2nd
Non Compliance with the requirements of general Order No. 5
dated Head Quarters of the Sub. Military Dist of The Rio Grande,
San Antonio, April 28th 1862.
In this, that, having come within the jurisdiction of the Sub Mil.
Dist. of the Rio Grande, from one of the States now at war with
the Confederate States, since the 2 st day of May 1861, he has failed
to satisfy the authorities as to the purposes for which he came, and
the causes that detain him.

Judge Advocate: Mr. Means you have heard the Charges prefered
against you & how say you,-Guilty or Not Guilty?
To which the accused W. P. M. Means pleaded as follows:
"Not Guilty."
Private. Geo. C. Bennett of Duff's Co. T. P. D. a witness on the
part of the Prosecution, was duly sworn.
